Definitions

When the terms, We, Our and US are used on the Air Way Bill, it refers to arrowexpress international (Pvt) Ltd, Its employees, Agents, Subsidiaries and Contractors. When you and your are used it refers to the SENDER its employees and Agents.

Terms of Agreement

When you give us your shipment to deliver, you agree to all of the TERMS IN THUS NON NEGITIABLE AIRWAY BILL and in our current tariffs and service guide which are available on request. If at the time of the shipment if there is a conflict between these terms and conditions and our current tariffs, later shall take precedence. The terms and conditions of our tariffs are made a part of this agreement. And no one is authorized to alter or modify those terms.

Limitation of Liability

unless our tariffs provide otherwise our limit of liability for loss or damages is the carriage of your shipment is solely by transport in, TO or FROM a country which is a part to the convention on the contract for international carriage of goods. Our liability for loss or damage to your Shipment or the part affected is limited to special drawing rights US$ 8.33 per kilo(approximately US$ 10 per kilo although the rate does vary from time to time).In the case of delay where you can show to us you have suffered loss our liability is limited to refunding to you the charge you paid us for carriage in respect of that Shipment of the part which was delayed. If neither of above conventions applies for whatever reason including breach of contract, negligence or willful act or default, we limit our liability for loss, Of damages to your Shipment or the part affected to US$15per kilo. Unless you designate a higher Shipment value and pay and additional fee WE ARE NOT LIABLE IN ANY EVENT FOR ANY SPECIAL , INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR LOSS OF INCOME, WETHER OR NOT WE HAD KNOWLEDGE THAT SUCH DAMAGES MIGHT BE INCURRED. We will not be liable for your acts or omissions including but not limited, to inadequate packing securing making or addressing or for acts omissions of the receiver or any other party having an interest in the Shipment. We will not be liable if you or the receiver violates any terms of this agreement. We also are not liable for loss damage or delay caused by circumstances outside out of our control including but not limited to acts of GOD perils the accidents, earthquakes, cyclones, storms, flooding, fire, disease, fog, snow, frost, air weather conditions, mechanical aircraft failure, acts of public enemies, civil war commotions or acts or omissions of public authority such as customs and quarantine officials who have actual or apparent authority.

Insurance

Shipper (You) may if desire insure the Shipment at your own cost.

Declared Value Limits

Declared value limits vary by country if you are not aware of the limits. International letter express or business document shipments will only be accepted with no value declared. (NCV)

RESPONSIBILITY FOR PACKAGING AND COMPLETING AIRWAY BILL

You are responsible for adequate packing and for accurately completing airway bill. Any errors may result in a rebilling by us to you.

FILING CLAIM

All claims for reimbursement except over charges must be made in writing to us within 30days. However in case of damage you must submit us a written complaint either on the airway bill or by a separate notice within 7 days after delivery of the Shipment. Or in case of delay no later than 14days from the date of delivery or refusal of the shipment. If the receiver accepts your Shipment without nothing at the time of delivery damage or any loss on the delivery record, we will assume that the Shipment was delivered in good condition. We will not pay any claims until the transportation charges have been paid in our account. You must not deduct the amount of the claim from transportation charges.

RIGHT TO INSPECT

We may it our option open and inspect any Shipment for any reason including but not limited to verification of contents prior to or after acceptance of the shipment for transportation.

QUALIFIED ACCEPTANCE

We reserve the right to reject your shipment after acceptance and prior to performance of any part of the transportation services. When such Shipment might cause damage or delay to other Shipments, equipment or personal. This will also apply of the transportation of your shipment is prohibited by LAW or is in VIOLATION of any rules contained in airway bill or our tariffs.

COMPLIANCE WITH THE LAWS AND REGULATIONS

You are responsible for compliance with all applicable customs IMPORTS and EXPORTS LAWS AND OTHER GOVERNMENT REGULATIONS of any country TO,FROM, THROUGH OR OVER WHICH THIS SHIPMENT MAY BE CARRIED AND SHALL FURNISHED SUCH INFORMATION AND ATTACH SUCH DOCUMENTS MAY BE NECESSARY TO COMPLY WITH SUCH LAWS AND REGULATIONS. If you fail to complete the necessary documents you here by authorize us to complete the documents for you at your expense but we are not obligated to do so.

EXPORT CONTROL

For export control and customs purposes you hereby authorize us to act as forwarding agent on your behalf.

CUSTOMS CLEARANCE

You hereby appoint us as your agent for the purpose of customs clearance for you and authorize us to designate a customs broker to perform such customs clearance.
